TERMS OF SERVICE AND CONDITIONS OF SALE

LOWRY CUSTOMS LLC
Version: TOS-2026-10-21
Last Updated: October 22, 2026

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR LEGAL RIGHTS, INCLUDING A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER (SECTION 18), LIMITATIONS ON CANCELLATIONS AND RETURNS (SECTIONS 6 AND 7), RULES GOVERNING PAYMENT DISPUTES AND CHARGEBACKS (SECTION 9), WARRANTY TERMS AND DISCLAIMERS (SECTION 11), AND LIMITATIONS OF LIABILITY (SECTION 15).

1. Acceptance of These Terms

1.1 These Terms of Service and Conditions of Sale ("Terms") form a legally binding agreement between you ("you," "your," "Customer," or "Buyer") and Lowry Customs LLC, an Ohio limited liability company, with its principal place of business at 282 Cavalcade LN SW, Pataskala, Ohio 43062 ("Lowry Customs," "Company," "we," "us," or "our").

1.2 These Terms govern your use of www.lowrycustoms.com and every purchase of products, parts, components, custom fabrication, or services (collectively, "Products") from us. This includes purchases made through our online store, cart, and checkout; customer accounts; the order status page; invoices and payment links we send you; express or accelerated checkout methods (such as Shop Pay, Apple Pay, Google Pay, and PayPal); and orders placed by phone, email, text message, or in person (collectively, the "Website" or "Store").

1.3 How You Accept These Terms. You accept these Terms by doing any of the following:

  • (a) checking the required box on our cart page, product page, or checkout that reads "I have read and agree to the Terms of Service, Refund Policy, Shipping Policy, and Warranty Terms, including the no-cancellation rules for custom and made-to-order parts and the chargeback policy";
  • (b) clicking "Pay now," "Complete order," or a similar button at checkout, where these Terms and our other policies are linked;
  • (c) completing a purchase through an express or accelerated checkout method;
  • (d) paying an invoice, deposit, or balance through a payment link we send you;
  • (e) confirming a deposit, pre-order, or other purchase option at checkout; or
  • (f) creating a customer account.

If you do not agree to these Terms, do not place an order.

1.4 Electronic Record of Acceptance. For each order, our e-commerce platform and its apps record and store information with the order. This includes the date and time the order was placed and the date and time you checked the acceptance box. It also includes the version of these Terms you accepted, your IP address and browser information, your billing and shipping details, and the results of our payment processor's address (AVS) and security code (CVV) checks. You agree that this electronic acceptance is your signature. It has the same legal effect as a handwritten signature under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN) and the Ohio Uniform Electronic Transactions Act (Ohio Revised Code Chapter 1306).

1.5 Changes. We may change these Terms at any time by posting a revised version at www.lowrycustoms.com/policies/terms-of-service with a new version number and "Last Updated" date. Each order is governed by the version of these Terms in effect when you placed that order. If you pay an invoice or balance later, the version in effect when the original order or invoice was created still governs that order.

1.6 Our E-Commerce Platform and Payment Providers. Our online store is hosted on Shopify, a third-party e-commerce platform. Payments are processed by third-party payment providers, which may include Shopify Payments, Shop Pay, PayPal, Apple Pay, and Google Pay ("Payment Providers"). Shopify and the Payment Providers are not parties to this agreement and do not sell you any Products. Your use of a Payment Provider may also be subject to that provider's own terms. Your contract for the purchase of Products is solely with Lowry Customs.

1.7 Order Notes Do Not Change These Terms. Notes, comments, or instructions you enter in the cart, at checkout, or in an order note do not change these Terms. They also do not create any warranty or obligation unless we agree to them in writing, for example in an invoice or email that we send.

2. Eligibility

You must be at least 18 years old and legally able to enter into contracts to use the Website or buy Products. By placing an order, you confirm that you meet these requirements. You also confirm that all information you give us is true, accurate, and complete, and that you are authorized to use the payment method you provide.

3. Definitions

  • "Standard Product" means any Product that we list on the Website in a fixed configuration, ready to ship from inventory.
  • "Made-to-Order Product" means any Product that we build, cut, machine, weld, coat, or assemble after you order it, even if it uses a standard design.
  • "Custom Product" means any Product built to your specifications, measurements, drawings, vehicle data, or requests, or any Product that we modify, personalize, or change from its standard listing.
  • "Order Date" means the date we send you an order confirmation.
  • "Production Start" means the moment we begin ordering material, programming, cutting, machining, fabricating, or otherwise working on your order.

4. Products, Pricing, and Errors

4.1 Descriptions. We try to describe Products, dimensions, fitment, and images accurately. Because our Products are fabricated and machined, small variations in finish, appearance, color, and dimensions within normal manufacturing tolerances are not defects. They are not grounds for cancellation, return, refund, or chargeback.

4.2 Fitment. Fitment information is for general guidance only. Before ordering, you are responsible for confirming that a Product is compatible with your vehicle, equipment, and intended use. Examples include your vehicle's year, make, model, drivetrain, lift height, tire size, and existing modifications.

4.3 Pricing. Prices are in U.S. Dollars and may change without notice. Prices do not include taxes, shipping, handling, duties, or insurance unless stated.

4.4 Errors. If a Product is listed at the wrong price or with wrong information because of a typographical, system, or other error, we may refuse or cancel any order for that Product, even after we have confirmed it. If your payment has already been charged, we will refund the amount charged.

4.5 Order Acceptance. Your order is an offer to buy. A contract is formed only when we send an order confirmation. We may refuse or cancel any order for any lawful reason, including suspected fraud, unauthorized activity, or inventory limits.

5. Payment and Authorization

5.1 You authorize us and our Payment Providers to charge your selected payment method for the full order amount. This includes any deposits, balances, taxes, shipping charges, and other charges described in these Terms.

5.2 Statement Descriptor. Charges from us will appear on your card or bank statement as "LOWRY CUSTOMS" or a similar name. Before you dispute a charge as unrecognized, please check your order confirmation email or contact us.

5.3 Deposits and Balance Payments. Some Made-to-Order and Custom Products are sold with a deposit or deferred-payment purchase option. In that case:

  • (a) the deposit amount, which is 50% of the Product price or a fixed amount shown on the product page (the "Deposit"), is charged at checkout, and the remaining balance and its due date or trigger are shown in the order summary;
  • (b) at checkout, you must confirm that you understand you are buying a Product with a deposit or deferred-payment option;
  • (c) you authorize us and our Payment Providers to store your payment method and to charge it for the remaining balance, without further action from you, when the balance becomes due. The balance becomes due when we notify you that your order is complete. Before we charge it, we will send you an email notice at least 5 days in advance; and
  • (d) if the balance charge fails or your bank requires you to confirm the charge, we will email you a secure payment link. If you do not pay within 7 days after we send that link, the order is treated as abandoned under Section 6.5.

5.4 Custom Quotes and Invoices. For Custom Products, we may send you a quote or invoice by email with a secure payment link. The invoice will describe or attach the specifications, drawings, materials, finish, price, Deposit, and estimated lead time for your order. When you pay any part of the invoice, you (a) accept these Terms, (b) approve the specifications described or attached to the invoice, and (c) authorize Production Start. You may pay the balance through a later invoice, through a saved payment method under Section 5.3, or by another method we approve in writing.

5.5 Billing Information. You must give us a valid billing address that matches the address on file with your card issuer. We may hold, verify, or cancel any order with a billing or shipping mismatch, or any order that our payment systems flag as high-risk.

5.6 Verification. To prevent fraud, we may ask for additional verification before we process or ship an order. This applies especially to orders flagged by our platform's fraud analysis, orders with mismatched billing and shipping addresses, and high-value orders. This may include a government-issued photo ID, a signed authorization form, a photo of the card (with all but the last four digits covered), or confirmation by phone. If you do not provide the verification we request within 3 business days, we may cancel the order, minus any fees that apply under Section 6.

6. Order Cancellations

You agree that we start spending money, buying materials, and scheduling shop time as soon as you place an order. The cancellation rules below reflect those real costs. You agree that the fees below are a reasonable estimate of our damages and are not a penalty.

6.1 Standard Products.

  • (a) Before shipment: You may cancel by written notice to orders@lowrycustoms.com. We will refund the purchase price minus a cancellation fee of 20% of the order total, plus any non-refundable payment processing fees.
  • (b) After shipment: You may not cancel. Section 7 (Returns) applies instead.

6.2 Made-to-Order Products.

  • (a) Before Production Start: You may cancel by written notice. We will refund the purchase price minus a cancellation fee of 25% of the order total.
  • (b) After Production Start: You may not cancel the order, and you remain responsible for the full purchase price. Any Deposit is non-refundable.

6.3 Custom Products. ALL CUSTOM PRODUCT ORDERS ARE FINAL AND CANNOT BE CANCELLED, RETURNED, OR REFUNDED ONCE YOU APPROVE THE DESIGN, DRAWING, QUOTE, OR SPECIFICATIONS, OR ONCE PRODUCTION STARTS, WHICHEVER COMES FIRST. Custom Products are made specifically for you and generally cannot be resold. Your Deposit is non-refundable once you approve a design or once Production Start occurs.

6.4 Design Approval. If we send you a drawing, render, quote, invoice, or specification sheet, your approval in writing (including by email or text message) or your payment of any part of the related invoice confirms that the specifications are correct. You are solely responsible for any error in measurements, dimensions, or specifications that you supplied or approved.

6.5 Abandoned Orders. An order is abandoned if (a) you do not pay the balance due, or (b) you do not respond to our communications for 30 days after we notify you that your order is complete. If an order is abandoned, you forfeit all amounts paid and the Product. We may then sell, scrap, or otherwise dispose of the Product without further obligation to you. We may also charge storage fees of $100 per day beginning 5 days after the completion notice.

6.6 How to Request a Cancellation. To request a cancellation, email orders@lowrycustoms.com with your order number. A cancellation is effective only when we confirm it in writing. Disputing the charge with your bank or Payment Provider is not a cancellation, and it is governed by Section 9.

6.7 Labels in the Store. Made-to-Order Products, Custom Products, and final-sale items are labeled as such on the product page and in the cart. Final-sale items cannot be selected for return through our online return request system. If an item's label conflicts with these Terms, these Terms control.

6.8 Our Right to Cancel. If we cancel your order for reasons other than your breach, suspected fraud, or failed verification, we will refund all amounts you paid for that order. A refund is your only remedy in that case.

7. Returns and Refunds

7.1 Eligibility. Only unused, uninstalled Standard Products in original, resaleable condition and original packaging may be returned. You must request a return within 5 days after delivery, either through the "Request return" option in your customer account or order status page, or by emailing orders@lowrycustoms.com. No Product may be returned until we approve the request in writing and give you return instructions or a Return Merchandise Authorization ("RMA") number. Products marked as final sale cannot be returned.

7.2 Non-Returnable Items. These items cannot be returned: (a) Made-to-Order and Custom Products; (b) any Product that has been installed, test-fitted on a vehicle, modified, welded, drilled, cut, painted, coated, or used; (c) electrical components that have been connected; (d) clearance, sale, or "As-Is" items; (e) hardware kits that have been opened; and (f) special-order items from third-party suppliers.

7.3 Restocking Fee. Approved returns are subject to a restocking fee of 25% of the purchase price. The fee is shown when you request a return and is deducted from your refund. Original shipping charges are not refunded. You pay return shipping, and you bear the risk of loss until we receive the return.

7.4 Inspection. We will inspect each return when we receive it. If a return does not meet Section 7.1, we may refuse it, return it to you at your expense, or reduce the refund to reflect damage, missing parts, or wear.

7.5 Refund Method. Approved refunds are issued to the original payment method within 10 business days after inspection. We do not issue refunds in cash or to a different card or account.

8. Shipping, Risk of Loss, and Delivery Inspection

8.1 Lead Times. Shipping and production times are estimates only. They are not guaranteed, and delays do not entitle you to cancel a Made-to-Order or Custom Product after Production Start.

8.2 Risk of Loss. Title to Products and risk of loss pass to you when we deliver the Products to the shipping carrier. You may buy shipping insurance at checkout. If you do not, we are not responsible for loss or damage in transit, though we will reasonably help you file a claim with the carrier.

8.3 Proof of Delivery. Carrier tracking that shows delivery to the shipping address you gave us is conclusive proof of delivery. This includes the tracking record attached to your order, the carrier's delivery photo, and any signature record. For orders over $500, we may require an adult signature at delivery.

8.4 Inspection on Delivery. You must inspect all Products within 3 days after delivery. You must report any shipping damage, missing items, or wrong items to us in writing within that period, with photos of the Product and packaging. If you do not report a problem within that period, you have accepted the Products as delivered and waive any claim for shipping damage, shortage, or non-conformity that a reasonable inspection would have revealed. This does not affect your rights under any warranty that applies to hidden defects.

8.5 Address Errors. You are responsible for giving us a correct and complete shipping address. Re-shipping charges caused by an incorrect address are your responsibility.

9. Payment Disputes and Chargebacks

9.1 You Agree to Contact Us First. If you have any problem with a charge, an order, or a Product, you agree to contact us first at support@lowrycustoms.com or 614-269-9704. You must give us at least 10 business days to resolve the issue before you start a chargeback, payment dispute, or reversal with your bank, card issuer, PayPal, or any other payment provider. Most issues can be resolved directly and faster.

9.2 Your Rights Under Law. Nothing in these Terms takes away any right you have under federal or state law to dispute a charge that is actually unauthorized or a billing error. That includes your rights under the Fair Credit Billing Act and the Electronic Fund Transfer Act.

9.3 Improper Chargebacks. A chargeback or payment dispute is "Improper" if it is filed (a) for a Product that was delivered as described, (b) to get out of a cancellation or return policy that you agreed to in these Terms, (c) after you have already received a refund or credit, (d) without first following Section 9.1, or (e) on a charge that you, a member of your household, or someone using your credentials with your permission actually authorized. Filing an Improper chargeback is a material breach of these Terms.

9.4 Consequences of an Improper Chargeback. If you file an Improper chargeback, then to the fullest extent allowed by law:

  • (a) you remain liable for the full amount of the disputed charge;
  • (b) you agree to pay us an administrative fee of $500 per dispute, plus any chargeback fees our payment processor charges us, which reimburses our actual costs of responding to the dispute;
  • (c) you agree to pay our reasonable costs of collection, including collection agency fees, court costs, and reasonable attorneys' fees;
  • (d) we may cancel any open orders, stop any work in progress, and refuse future orders from you; and
  • (e) we may refer the unpaid amount to a collection agency, report it as permitted by law, and pursue it in small claims court or as otherwise allowed under Section 18.

9.5 Evidence. You agree that, to respond to a chargeback or payment dispute, we may give your bank, card issuer, Payment Providers, and their agents the following:

  • these Terms (in the version you accepted) and your electronic acceptance record, including the acceptance timestamp and version stored with your order;
  • your order details, customer order history, IP address, device and browser data, and AVS/CVV results;
  • all communications between us, including emails, text messages, chat logs, and call notes;
  • invoices, quotes, drawings, and design approvals;
  • photos and videos of your Product during production, before shipment, and as delivered; and
  • shipping, tracking, delivery photo, and signature records.

9.6 Fraudulent Transactions. If you use a stolen, unauthorized, or fraudulent payment method, give false information, or falsely claim that an order was not authorized or not received, we may report the matter to law enforcement, card networks, and fraud prevention services. We may also pursue all civil and criminal remedies available. This includes remedies under Ohio Revised Code Section 2913.02 (theft) and Section 2913.21 (misuse of credit cards).

9.7 Reversal of a Successful Improper Chargeback. If a chargeback is decided in your favor but we later show it was Improper, the original charge becomes a debt you owe us, plus the amounts in Section 9.4.

10. Use of the Website

You agree not to: (a) use the Website for any unlawful purpose; (b) try to get unauthorized access to the Website or its systems; (c) copy, collect, or download Website content or data by automated means; (d) send malware, spam, or harmful code; or (e) pretend to be another person or business. We may suspend or end your access at any time for violating these Terms.

11. Warranties

11.1 General Warranty Terms

(a) Warranty Categories. Every Product we sell falls into one of the three warranty categories below. Each product page shows its category, with a link to the full warranty terms. A full list is in Appendix A (Product Warranty Schedule), which is part of these Terms. You can read the text of each warranty before you buy, at www.lowrycustoms.com/pages/warranty and on request by mail or email. If a product page and Appendix A conflict, the category shown on the product page when you ordered controls.

(b) Who Is Covered. Unless otherwise stated, each warranty covers only the original retail purchaser who bought directly from Lowry Customs or an authorized dealer. It is not transferable.

(c) Proof of Purchase. You must provide proof of purchase (order number or receipt) for every warranty claim.

(d) Warrantor. The warrantor is Lowry Customs LLC, 282 Cavalcade LN SW, Pataskala, Ohio 43062, 614-269-9704, warranty@lowrycustoms.com.

11.2 LIMITED LIFETIME WARRANTY

Products covered: Products listed in Appendix A, Category A.

(a) What Is Covered. We warrant that Category A Products will be free from defects in materials and workmanship under normal use for the Lifetime of the Product, as defined below.

(b) Definition of "Lifetime." "Lifetime" means as long as the original purchaser owns the Product and it stays installed on the original vehicle or equipment on which it was first installed. Coverage ends if the Product is sold, transferred, or moved to another vehicle or equipment. If we discontinue a Product, "Lifetime" will not be less than 5 years from the original purchase date.

(c) Wear Items Not Covered. Even for Category A Products, the following wear items are not covered by the Limited Lifetime Warranty: heim joints / rod ends, bushings, poly or rubber components, bearings, hardware, fasteners, powder coat and other finishes, and other normal wear items. The only exception is lifetime heim joints: heim joints on Products sold as "Lifetime Heim" Products, and heim joints ordered with the "Lifetime Warranty" heim joint option, are covered by this Limited Lifetime Warranty. Other wear items, if listed in Appendix A, are covered only by the One (1) Year Limited Warranty in Section 11.3, or are sold with No Warranty (Section 11.4).

(d) What We Will Do. If a covered defect occurs, we will choose to either repair the Product or replace it with the same or an equivalent Product. If repair or replacement is not commercially practical, we may instead refund the purchase price you paid for the Product.

(e) What We Will Not Pay For. This warranty does not cover labor to remove or reinstall the Product, towing, rental vehicles, alignment, lost time, travel, or shipping costs to us. We will pay return shipping of a repaired or replacement Product to you within the contiguous United States.

11.3 ONE (1) YEAR LIMITED WARRANTY

Products covered: Products listed in Appendix A, Category B.

(a) What Is Covered. We warrant that Category B Products will be free from defects in materials and workmanship under normal use for one (1) year from the date of delivery to the original purchaser.

(b) What We Will Do. If a covered defect occurs during the warranty period, we will choose to either repair or replace the Product, or refund the purchase price.

(c) What We Will Not Pay For. The same cost exclusions in Section 11.2(e) apply.

(d) Replacement Parts. A repaired or replacement Product is covered only for the rest of the original one (1) year warranty period.

11.4 NO WARRANTY ("AS IS")

Products covered: Products listed in Appendix A, Category C, and any Product labeled "As-Is," "Blem," "Prototype," "Used," "Clearance," "Race Only," "Off-Road Only," or "No Warranty."

CATEGORY C PRODUCTS ARE SOLD "AS IS" AND "WITH ALL FAULTS." LOWRY CUSTOMS MAKES NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, FOR CATEGORY C PRODUCTS. LOWRY CUSTOMS SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY AND THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF CATEGORY C PRODUCTS IS WITH THE BUYER. IF A CATEGORY C PRODUCT IS DEFECTIVE, THE BUYER, NOT LOWRY CUSTOMS, PAYS THE ENTIRE COST OF ALL NECESSARY SERVICING OR REPAIR.

11.5 Warranty Exclusions (All Categories)

No warranty covers damage, failure, or wear caused in whole or in part by any of the following:

  • Improper installation, or installation not done according to our instructions or not done by a qualified professional;
  • Racing, competition, drag racing, sled pulling, rock crawling, jumping, off-road abuse, or any use beyond the Product's stated rating or intended purpose (unless the Product is specifically sold and warranted for that use);
  • Accidents, collisions, impacts, road debris, or acts of nature;
  • Modification, cutting, welding, drilling, grinding, heating, bending, re-coating, or any change to the Product not done by us;
  • Use with incompatible, worn, or failed parts, or failure of other vehicle components;
  • Lack of reasonable maintenance, including failure to check torque, inspect, lubricate, or tighten fasteners and joints as instructed;
  • Corrosion, rust, chips, fading, or finish wear from road salt, chemicals, weather, or normal use;
  • Normal wear and tear, noise, or vibration that does not affect function;
  • Commercial, fleet, rental, or agricultural use, unless stated otherwise in Appendix A;
  • Products bought from unauthorized sellers, or Products whose serial number or markings have been removed or altered.

Nothing in this Section requires you to use any particular brand of part or service to keep your warranty. However, we may deny coverage if we show that a part or service not supplied by us caused the defect or damage.

11.6 How to Make a Warranty Claim

  • Email warranty@lowrycustoms.com within 30 days after you discover the defect, and within the warranty period. Include your order number, a description of the problem, clear photos or video of the Product as installed, your vehicle information, and installation details.
  • Do not remove, alter, or ship the Product until we review your claim and issue an RMA number, unless we tell you otherwise.
  • If we ask, ship the Product to us prepaid, with the RMA number clearly marked on the package.
  • We will inspect the Product and decide within 10 business days after we receive it whether the claim is covered. Our decision will be based on our reasonable inspection and will be explained to you in writing.
  • If the claim is not covered, we will contact you. You may choose to have the Product returned to you at your expense or to pay for repair at our standard rates.

11.7 Limitation on Implied Warranties (Categories A and B)

FOR CATEGORY A AND CATEGORY B PRODUCTS, ANY IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE DURATION OF THE APPLICABLE WRITTEN LIMITED WARRANTY ABOVE. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

11.8 Exclusive Remedy; No Incidental or Consequential Damages

REPAIR, REPLACEMENT, OR REFUND AS DESCRIBED ABOVE IS YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY WARRANTY CLAIM. LOWRY CUSTOMS IS NOT LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING DAMAGE TO YOUR VEHICLE OR OTHER PROPERTY, LOST TIME, LOST PROFITS, TOWING, OR LOSS OF USE. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

11.9 Your State Law Rights

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

11.10 No Other Warranties

No employee, agent, dealer, or other person may change, extend, or add to these warranties, whether orally or in writing. Any statements made in conversation, on social media, or in advertising are not warranties unless they appear in these Terms or in Appendix A.

12. Product Use, Installation, and Assumption of Risk

12.1 Professional Installation. Many of our Products are suspension, drivetrain, steering, and structural components that affect vehicle handling, braking, and safety. We strongly recommend that all Products be installed by a qualified, professional mechanic or fabricator. If you install a Product yourself, you do so at your own risk.

12.2 Inspection and Maintenance. You agree to inspect each Product before installation, check fasteners and joints after installation and at regular intervals, and stop using any Product that shows signs of damage, cracking, looseness, or unusual wear.

12.3 Off-Road and Competition Use. Some Products are sold for off-road or competition use only, and may not be legal for use on public roads. You are solely responsible for knowing and following all federal, state, and local laws that apply to vehicle modifications, lighting, emissions, ride height, bumper height, and safety equipment.

12.4 Vehicle Manufacturer Warranty and Insurance. Installing aftermarket parts may affect your vehicle manufacturer's warranty, your vehicle's handling characteristics, and your insurance coverage. We are not responsible for any of these effects.

12.5 ASSUMPTION OF RISK. YOU UNDERSTAND THAT MODIFYING A VEHICLE AND DRIVING A MODIFIED VEHICLE, ESPECIALLY OFF-ROAD OR IN COMPETITION, INVOLVES INHERENT RISKS OF PROPERTY DAMAGE, SERIOUS INJURY, AND DEATH. TO THE FULLEST EXTENT ALLOWED BY LAW, YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL SUCH RISKS.

13. Custom Work and Customer-Supplied Specifications

13.1 If you supply measurements, drawings, CAD files, specifications, vehicle data, or design instructions, you confirm that they are accurate and that you have the right to use them. We are not responsible for any defect, fitment problem, or failure that results from information you supplied or approved.

13.2 We may refuse any custom work that we believe in our judgment is unsafe, unlawful, or beyond our capabilities.

13.3 You agree to indemnify us (as described in Section 16) against any claim that a design or specification you supplied infringes someone else's intellectual property rights.

14. Intellectual Property

All Website content, logos, product designs, CAD drawings, DXF/DWG files, photos, instructions, and trademarks are the property of Lowry Customs or its licensors and are protected by U.S. and international law. Buying a Product does not give you any right to copy, reverse engineer for resale, reproduce, or manufacture our designs. Unless we agree otherwise in writing, we keep ownership of all drawings, programs, tooling, and design files that we create, including those created for Custom Products.

15. Limitation of Liability

15.1 TO THE FULLEST EXTENT ALLOWED BY LAW, LOWRY CUSTOMS AND ITS OWNERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND ARISING FROM OR RELATED TO THE WEBSITE, THESE TERMS, OR ANY PRODUCT. THIS APPLIES WHETHER THE CLAIM IS BASED ON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE WERE TOLD THAT SUCH DAMAGES WERE POSSIBLE.

15.2 TO THE FULLEST EXTENT ALLOWED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO A PRODUCT OR ORDER WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US FOR THAT PRODUCT.

15.3 Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the smallest amount allowed by law. Nothing in these Terms limits liability for death or personal injury caused by our gross negligence or willful misconduct, or for any other liability that cannot be limited by law.

16. Indemnification

To the fullest extent allowed by law, you agree to defend, indemnify, and hold harmless Lowry Customs and its owners, members, employees, and agents from all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your breach of these Terms; (b) your installation, modification, use, or misuse of any Product; (c) your violation of any law; (d) any specification, design, or information you supplied; or (e) any Improper chargeback or fraudulent transaction.

17. Release

To the fullest extent allowed by law, you release Lowry Customs from all claims arising from the use of any Product by you, or by anyone driving or riding in a vehicle on which you installed a Product, except claims under an applicable written warranty in Section 11 or claims that cannot be released under law.

18. Dispute Resolution, Binding Arbitration, and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHT TO SUE IN COURT.

18.1 Informal Resolution First. Before starting any arbitration or lawsuit, you and we each agree to send the other a written notice describing the dispute and the relief requested, and to try in good faith to resolve the dispute informally for at least thirty (30) days. Notices to us must be sent to tyler@lowrycustoms.com and 282 Cavalcade LN SW, Pataskala, Ohio 43062.

18.2 Binding Arbitration. If the dispute is not resolved informally, then any dispute, claim, or controversy arising out of or relating to these Terms, the Website, any Product, any order, or our relationship (each, a "Dispute") will be resolved by final and binding individual arbitration, rather than in court. This includes disputes about whether this arbitration agreement is valid, enforceable, or applies. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (for consumers) or Commercial Arbitration Rules (for business purchasers) in effect at the time. Arbitration will take place in Licking County, Ohio, or by video or phone, or by written submissions if the claim is under $10,000. Judgment on the arbitrator's award may be entered in any court with jurisdiction. This arbitration agreement is governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq.

18.3 Exceptions. Either party may (a) bring an individual claim in small claims court in Licking County, Ohio, if the claim qualifies; (b) seek an injunction or other equitable relief in court to protect intellectual property; and (c) pursue collection of unpaid amounts, including amounts owed because of an Improper chargeback, in small claims court or any court of competent jurisdiction.

18.4 CLASS ACTION AND JURY TRIAL WAIVER. YOU AND WE EACH AGREE THAT DISPUTES WILL BE BROUGHT ONLY ON AN INDIVIDUAL BASIS, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL.

18.5 Right to Opt Out. You may opt out of this arbitration agreement by sending written notice to tyler@lowrycustoms.com within thirty (30) days after you first accept these Terms. The notice must include your name, address, order number, and a clear statement that you want to opt out of arbitration. Opting out does not affect any other part of these Terms.

18.6 Time Limit for Claims. To the fullest extent allowed by law, any Dispute must be brought within one (1) year after it arises, or it is permanently barred. This does not shorten any warranty period or statute of limitations that cannot be shortened under law.

18.7 Severability of This Section. If the class action waiver in Section 18.4 is found unenforceable for any Dispute, then that Dispute (and only that Dispute) must be decided in court under Section 19, and not in arbitration.

19. Governing Law and Venue

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law rules, and by applicable federal law. For any Dispute that is not subject to arbitration, you agree to the exclusive personal jurisdiction and venue of the state courts in Licking County, Ohio, and the United States District Court for the Southern District of Ohio, Eastern Division. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

20. Attorneys' Fees

In any action to collect amounts owed under these Terms (including Improper chargebacks), or to enforce these Terms, the prevailing party may recover its reasonable attorneys' fees and costs, to the extent permitted by applicable law.

21. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control. Examples include acts of nature, fire, flood, severe weather, pandemics, labor disputes, material shortages, supplier delays, carrier delays, power or internet outages, government actions, and equipment breakdowns.

22. Privacy

Your use of the Website is also governed by our Privacy Policy at www.lowrycustoms.com/policies/privacy-policy, which is part of these Terms. You consent to our collection and use of order, payment, device, and communications data as described there, including for fraud prevention and dispute response.

23. Electronic Communications

You agree to receive communications from us electronically about your orders, designs, invoices, balance payments, warranty claims, and disputes. These include order confirmation and shipping emails, invoices and payment links, order status page updates, emails, and text messages. Electronic communications satisfy any legal requirement that a communication be in writing. Messages that you send or approve by email or text, including design approvals, are binding.

24. General Provisions

24.1 Entire Agreement. The following documents are the entire agreement between you and us, and they replace all prior statements and agreements:

The Refund Policy, Shipping Policy, and Warranty page summarize parts of these Terms. If any of them conflicts with these Terms, these Terms control. If a written quote or invoice that we send conflicts with these Terms, the quote or invoice controls only for the specific term it addresses.

24.2 Severability. If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent allowed, and the remaining provisions will stay in full effect.

24.3 No Waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

24.4 Assignment. You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

24.5 Survival. Sections 6, 7, 9, 11, 12, and 14 through 24 survive the completion, cancellation, or termination of any order or of these Terms.

24.6 Headings. Headings are for convenience only and do not affect interpretation.

24.7 Relationship. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship.

24.8 Consumer Rights. Nothing in these Terms is meant to limit any right that cannot be waived or limited under applicable consumer protection law, including the Magnuson-Moss Warranty Act and the Ohio Consumer Sales Practices Act. These Terms will be read to give effect to that intent.
